KUALA LUMPUR: Menteri di Jabatan Perdana Menteri, Liew Vui Keong memfailkan rayuan terhadap keputusan Mahkamah Tinggi Kota Kinablu baru-baru ini yang mengisytiharkan pelantikan Amarjit Singh sebagai pengarah Jabatan Air Negeri Sabah pada tahun lalu tidak sah.
Pada 9 Okt lalu, Hakim Mahkamah Tinggi Kota Kinabalu, Ravinthran Paramaguru mengisytiharkan pelantikan Amarjit bertentangan Seksyen 3 Enakmen Bekalan Air Sabah 2003 yang menyatakan hanya penjawat awam boleh dilantik ke jawatan kanan JANS.“Dengan mengguna pakai pendekatan interpretasi statut secara literal, pengarah tidak boleh disamakan dengan ‘pegawai’ sebagaimana dinyatakan dalam Seksyen 3 enakmen tersebut.
“Dalam erti kata lain, pegawai dalam Seksyen 3 tidak termasuk pengarah JANS kerana beliau merupakan ‘Pihak Berkuasa Air’.”
