Pesuruhjaya Kehakiman Amarjeet Singh berkata Wakaf Abdul Cauder juga berada di luar bidang kuasa mahkamah sivil dan sepatutnya dikendalikan oleh mahkamah syariah seperti diputuskan sebelum ini oleh Mahkamah Persekutuan.Keputusan itu adalah berkaitan satu saman pemula yang difailkan oleh Muhamad Amin Abdul Rahman, yang menyaman Majlis Agama Islam Pulau Pinang dan 2 yang lain dengan mendakwa penagambilalihan tanah keluarganya oleh majlis berkenaan tidak sah.
Beliau memohon perisytiharan mahkamah bahawa beliau merupakan pemilik sah hartanah berkenaan, berdasarkan surat wasiat arwah neneknya, Kavana Ebrahim @ Burong.Amin berkata, ini selari dengan suratikatan pemegang amanah bertarikh 17 Ogos 1892, yang menetapkan waris beliau sebagai pemegang amanah tanah berkenaan.
MEHB kini dikenali sebagai Lembaga Wakaf Hindu, sementara wakaf orang Islam ditadbir oleh pihak berkuasa agama Islam negeri sejak negara mencapai kemerdekaan.
