Labuan MP fails to transfer abuse of power case to High Court

In dismissing the MP's application on Tuesday , High Court judge Justice Muhammad Jamil Hussin said the defence failed to satisfy the requirements for a transfer under Section 417 of the Criminal Procedure Code.

Deputy public prosecutor Ahmad Feisal Mohd Azmi appeared for the prosecution while Muhammad Rafique Rashid Ali represented Rozman.Labuan MP fails to quash abuse of power charge On Oct 14, Rozman, 58, claimed trial to a charge of abuse of power in relation to a contract for a company linked to his family members.

The Parti Warisan MP was accused of using his position as Labuan Port Authority deputy chairman to secure an employment contract as an operator of Dermaga Merdeka Pelabuhan Labuan for Labuan Liberty Port Management Sdn Bhd, in which his father and brother have stakes.The offence was allegedly committed at the Transport Ministry headquarters, Jalan Tun Hussein, Precinct 4, Putrajaya between 2.30pm and 5.30pm on March 23, 2018.

The charge under Section 23 of the Malaysian Anti-Corruption Commission Act 2009 carries a maximum 20-year jail term and a fine not less than five times the amount or value of the gratification, whichever is higher, upon conviction.
