KUALA LUMPUR: Datuk Seri Najib Razak will once again use the affidavit by former attorney general Tan Sri Mohamed Apandi Ali in his bid to challenge the appointment of Datuk Seri Gopal Sri Ram as the prosecutor in his 1Malaysia Development Bhd (1MDB) trial.

Najib’s lawyer Tan Sri Muhammad Shafee Abdullah said a notice to use the supporting affidavit in the judicial review, which also involves Shafee as a plaintiff, had been served to the respondents on Monday .

Najib had first raised Apandi’s affidavit in his application on June 12 to have Sri Ram recused in the 1MDB audit report tampering case trial).In Apandi’s affidavit, the former AG had accused Sri Ram of trying to persuade him to arrest Najib over the 1MDB scandal.Shafee said there would be two counsels for both Najib and himself on the July 13 hearing, which is expected to last a whole day.

In December, 2018, Najib and Shafee had separately filed for the judicial review to challenge the Attorney General's decision to appoint Sri Ram as a deputy public prosecutor under Section 376 of the Criminal Procedure Code. They are also seeking a declaration that there is a conflict of interest in Sri Ram's appointment and request for an order to prohibit him from leading the prosecution team in all of their cases, including on corruption, abuse of power and money laundering.
