Bekas peguam negara Apandi Ali mohon perisytiharan bahawa pemecatannya oleh Dr Mahathir Mohamad tidak sah.
“Malah sekiranya Agong bertindak atas nasihat perdana menteri, ia hendaklah dilakukan secara objektif dan tidak dipengaruhi oleh pandangan peribadi Mahathir,” kata Shukor dalam hujahannya.Shukor berkata, Mahathir melakukan tort misfeasans sewaktu memegang jawatan awam kerana beliau membuat keputusan memecat Apandi tanpa menimbangkan pandangan Agong.
Shamsul berkata, jelas Apandi menjalankan “ekspedisi memancing untuk mendapatkan dokumen dalaman defendan yang beliau ternyata tidak mengetahui apa-apa mengenainya”. Terdahulu pada 31 Okt, beliau memfailkan permohonan meminta perisytiharan bahawa penamatan perkhidmatannya pada 2018 oleh Mahathir adalah tidak sah.
Apandi juga mendakwa Mahathir mempunyai pandangan berat sebelah terhadap dirinya dan membuat keputusan pemecatan itu tanpa mempedulikan kuasa Agong bawah Perlembagaan.
