THE government can only retable a Bill to abolish the Anti-Fake News Act 2018 after mid-August this year, says Prime Minister Tun Dr Mahathir Mohamad.

“The process cannot start earlier and can only be done a year after the Anti-Fake News Bill 2018 was passed by the Dewan Rakyat.

Although the Bill was passed by the Dewan Rakyat, Dr Mahathir said that it was rejected by the Dewan Negara, triggering Article 68 of the Federal Constitution for a one-year cooling period before it could be retabled.The Anti-Fake News Act 2018, which was passed under the former Barisan Nasional administration, came under fierce criticism from civil societies and the then Opposition.

The law came into force on April 11 last year, less than a month before the May 9 general election with Dr Mahathir being among those investigated under the law.Constitutional expert Prof Dr Shamrahayu A. Aziz was quoted as saying that under Article 68 of the Federal Constitution, Dewan Negara senators could merely delay the passing of an Act and not block it entirely.“The Act will be sent back to Dewan Rakyat for the MPs to have a relook,” she said in an interview in September last year.

It can only be brought to the Senate after a year from the date of the Act’s first passing, she said.
