A proposed Senate bill seeking to criminalize forced sterilizations in Canada is raising concerns that the new offences, as currently written, could have unintended consequences, including a potential chilling effect on reproductive and other medical care. The Senate Legal and Constitutional Affairs Committee began its study of Bill S-250 on Feb. 29.

” Under current assault law, proving lack of consent is an “essential element” to proving an offence has been committed, whereas in S-250, an offence is seen to have been committed unless consent is proved.
