Opinion: Return of the King’s Counsel designation a step backwards for Ontario. The problem with this designation is it misleads the public into thinking they are getting a good lawyer when the designation makes no such guarantee.

All jokes and curses aside, people need lawyers. If we are to be ruled by laws and not dictate, we need lawyers to draft them, properly interpret them, and, perhaps most importantly, advocate our positions as being correct under the law.The Law Society of Ontario, the body that regulates lawyers, does precious little to ensure members of the public get one.

To these individuals, however — both those in private practice and those who will eventually return to private practice — the designation means an ability to demand higher rates from the same unknowing public than those without it. But that is only unfair to other lawyers. The problem for all but those aware of what lies behind these appointments is that they will be misled into thinking they are getting a good lawyer when the designation guarantees nothing of the sort.

It would make law school admission solely a matter of merit and not the ability to afford outrageous tuitions.
