The judge found the bylaw violates the Charter rights of the encampment residents because of the region’s lack of adequate shelter spaces

The Region of Waterloo had asked the court to find that roughly 50 people living in a Kitchener, Ont., encampment were in violation of its trespassing bylaw.Sign up to receive daily headline news from Ottawa Citizen, a division of Postmedia Network Inc.By clicking on the sign up button you consent to receive the above newsletter from Postmedia Network Inc. The ruling comes after two decisions where Ontario judges ruled against residents fighting to prevent encampment evictions at city parks in Toronto and Hamilton. In those cases, the judges found there was adequate space to accommodate “all of the cities’ homeless,” Valente wrote. The encampment at the centre of the case is set on a half-acre empty gravel lot the region intended to use as parking for nearby transit stations.

The city hired a security firm in March to monitor the encampment and respond to any complaints, mostly from nearly businesses. On June 6, it posted a notice requiring residents to leave the property by end of the month.

Ontario judge denies request to clear Kitchener homeless encampment citing Charter violationThe Region of Waterloo had asked an Ontario court to find that roughly 50 people living in an encampment in Kitchener were in violation of its trespassing bylaw Would be a shame if the residents of the encampment were to relocate to the courthouse grounds or, perhaps, that judge’s front yard. wow nice. With more Canadians working remotely and preferring to not to work at the office maybe they could convert offices into homes for the homeless. fordnation maybe Doug can build more affordable housing instead of building 3000 sq homes on greenbelt land for the benefit of his rich friends

Judge denies request to clear Kitchener encampment citing Charter violationThe Region of Waterloo was asking the court to find that roughly 50 people were in violation of its trespassing bylaw. Does the judge care to give out his address so his neighbourhood can be used as a camp ground? Give the judge's address so the encampment moves out of the park and all these people go crap at the judge's door. C'mon, share the shit, will you? Because we're all fed up with these people shitting in our parks already 🤮🤮🤮

A ‘precedent-setting’ decision rules encampment clearing would violate Charter rightsAn Ontario court said a Waterloo Region encampment cannot be cleared given a lack of shelter space. It could mean a more ‘compassionate approach’ in Toronto. Cities should use their park spaces to build high rises on before the meth heads take full ownership. Pointy headed woke liberal judges and the woke liberal media! Good luck Peoplekind Well, if you thought things were looking grim in Canada before, they just got a lot worse.
