Info watchdog referred six potential criminal cover-ups to attorney general, unaware of subsequent investigations

“The six cases that the office referred to the attorney general were with respect to investigations that we felt that there was reasonable evidence of intent to obstruct the access request,” Information Commissioner Caroline Maynard told MPs on Tuesday.Canada’s Information Commissioner, Caroline Maynard, appears as a witness at a Senate Committee on Indigenous Peoples at the Senate of Canada Building in Ottawa on Tuesday, Feb. 27, 2024.

Canada’s Information Commissioner has referred six cases of government institutions failing to comply with access to information requests to the attorney general for further investigation, but hasn’t heard of any follow-up. Appearing before the House ethics committee on Thursday, Information Commissioner Caroline Maynard said her office has identified several instances over the last four years of people intentionally not complying with ATIP requests by either failing to provide documents or refusing to co-operate.

Under the Access to Information Act, Maynard cannot investigate situations where alleged criminal activity may have occurred, but she has the ability to refer these cases to the attorney general’s office, which she has done six times.
