ANALYSIS: Analysis: Will cannabis really be legal in Canberra next year? We'll find out when someone's arrested

The ACT drafted its legislation with the Commonwealth laws in mind, and it is relying on a provision that allows anyone charged with a Commonwealth offence to"justify or excuse" the conduct because it is legal under state or territory laws.

And he expects ACT Policing, which is a branch of the Australian Federal Police, to enforce the Commonwealth law prohibiting cannabis.Determining who is right or wrong on that one will possibly fall to the courts, and could require at least one unlucky person becoming a closely watched test case. Professor Desmond Manderson, from the Australian National University's law college, suggested this would be the most likely outcome.

The Commonwealth DPP advised that the legislation would likely be available as a defence to someone charged with a Commonwealth offence, and as such it might decide not to prosecute.Professor Manderson believes the ACT is on reasonably solid ground and cannabis users will be protection by its laws. It wants the ACT Government to come to an agreement with ACT Policing not to enforce the Commonwealth law.The society's Michael Kukulies-Smith said the current situation left both cannabis users and police officers in an untenable position.

Marijuana should NEVER be legalised anywhere in the Western social world. These idiots in Canberra need a serious reality check. Do they not know the proven mental and physical consequences of canibis intake. Our lungs are designed for oxygen not THC. Medicinal Yes Social No. 🚭

It will become one of those legal grey areas that can be used selectively to target individuals where most people are ignored but if they want to take down an individual they will decide to apply the law to them. Meanwhile everyone will have become complacent and so vulnerable.

Let’s all smoke it in a mass rally and see what happens.

If kava will be,why not cannabis? abcnews abc666 auspol
