The judge presiding over Bruce Lehrmann’s high-stakes defamation case is set to hear an urgent application by Network Ten to reopen its defence and introduce fresh evidence in court, less than 48 hours before the judgment was due to be delivered.
Dr Matt Collins, KC, acting for Ten, told the court on Tuesday that “the application we agitate is unusual and exceptional”. The court heard the application is opposed by Lehrmann.The network is seeking to introduce evidence from Taylor Auerbach, a former producer on Seven’sAuerbach was part of a team working to woo Lehrmann into striking an exclusive interview deal with the broadcaster in late 2022. Those efforts proved persuasive.
That material included extensive pre-interview material with his former colleague Brittany Higgins for Ten’s, which had been handed over to the Australian Federal Police under a search warrant as it investigated her claim she was sexually assaulted by Lehrmann in Parliament House.aired on February 15, 2021, Higgins accused an unnamed colleague of raping her in March 2019 in the office of the then-defence industry minister, Linda Reynolds, for whom they both worked as advisers.
However, there is no guarantee the judge will agree to hear the evidence on the eve of his judgment. Lee may form the view that casting doubt on the veracity of Lehrmann’s evidence in a peripheral way does not assist him to determine the issues at the heart of the case.
