The five key reasons behind the judge's sentencing decision on Borce Ristevski

Borce Ristevski was on Thursday sentenced to a maximum nine years behind bars with a non-parole period of six for the manslaughter of his wife Karen Ristevski.

Justice Christopher Beale spent about 45 minutes laying out his reasons for the sentence in Court 4 of the Supreme Court in Melbourne.It was a unique case in that prosecutors could not prove how Karen died. They could not say absolutely she was murdered, nor could they disprove that her husband accidentally killed her before covering up what had happened.

"In sentencing you, I must do so on the basis that, when you killed your wife, you did not do so with murderous intent ," he said.Justice Christopher BealeJustice Beale said Karen's death was a serious case of domestic violence, but he could not find if the offence was a mid or upper-range example of manslaughter.

"Many of the domestic violence homicides that I have looked at involve a history of domestic violence, not an outburst of isolated violence. In that regard, your case is atypical."
