If you're caught with an unprescribed nicotine vape in the nation's capital, the law states you can be fined 320 times more than if you were possession of a gram of heroin.
But the penalty for being found with small quantities of illicit drugs like heroin, ice, and MDMA is a $100 fine or a referral to an addiction treatment service. Minister Davidson said her government was working to substantially lower these fines by decriminalising liquid nicotine, found in products like e-cigarettes, in the same way it has for other illegal drugs.
The possession of liquid nicotine, which hasn't been prescribed or found in tobacco, falls under a different piece of legislation to the illicit drugs decriminalised last year.Which means anyone without a prescription for a nicotine vape could be penalised in the same way as someone in possession of other illegal scheduled poisons such as arsenic.
While police officers and public health officers may perform inspection and compliance functions under the Tobacco and Other Smoking Products Act 1927 Act , generally operational functions have been performed by Access Canberra. The ACT government does not yet have a timeline for their amended bill to be presented, but Ms Davidson vowed to have it tabled in parliament before the October election.
