Evie Amati attacked two strangers inside a 7-Eleven at Enmore and then chased down a nearby pedestrian in January 2017.

Appealing against the sentence, the Crown argued that, not only was the overall sentence inadequate, but that the individual sentences imposed were also too lenient.In an affidavit filed in the Supreme Court opposing the appeal, Amati said she understood the need for her incarceration, but appealed to the court not to extend her sentence.

Amati said she had made the decision to begin "de-transitioning" after coming to the realisation that she would never be accepted as a female by the community, a "social reality" she said she must accept. The judge said that, as Mr Rimmer lay on the ground following the attack, he thought of his pregnant wife whom he feared he might never see again.

When Amati put her leg against her date, she "recoiled not, you know, not as like a natural kind readjustment as if she was burned, as if she'd touched a leper or someone that was infected", the judge said from Amati's previous statement.
