Attorney-General and Minister for the Prevention of Domestic and Family Violence Shannon Fentiman said the government will now move to change the definition to replace the word "given" with "agreed".
The state will also move to make "stealthing" a crime by recognising it as rape, coming into line with NSW, Victoria, the ACT, South Australia and Tasmania where it is also illegal.Stealthing is when a partner secretly removes a condom during sex, without the other person's consent. The law reforms were among 188 recommendations from the final Women's Safety and Justice Taskforce's Hear her Voice report, which have all been supported or supported in principle by the state government.

Fair enough but what of all the other ways consent can be breached, e.g. sperm jacking? I could think of many others across multiple genders, the standard definition of consent surely should encompass this low act.
Stealthing is wrong, however with all laws these days it will 'creep' and before you know you will be charged with stealthing when the condom broke.
. Totally ridiculous. It'll go through because nobody can oppose dumb laws these days without being attacked. This law will make 'stealthing' during otherwise consensual sex the SAME CRIME as a man holding down a woman and forcibly raping her. Absolutely ridiculous. .

Will claiming to be on the pill or otherwise safe when not be criminalised? How is affirmative consent to be recorded for future reference if required?

Stealthing and rape is almost the same thing obviously. Just ask anyone who has been raped - I am sure they would think it is basically the same thing.
