Worksafe Victoria has charged St Basil's Homes for the Aged in Victoria with nine breaches of the Occupational Health and Safety Act following a deadly coronavirus outbreak in 2020 which claimed the lives of 45 residents.

Worksafe Victoria on Monday announced it had charged St Basil’s Fawkner care facility in Melbourne’s north with nine breaches of the Occupational Health and Safety Act.

It also alleged St Basil’s failed to train workers on how to safely wear and remove PPE, inform staff when it should be worn and supervise its use. If the aged care provider is found guilty, each alleged breach occurred under the Occupational Health and Safety Act carries a fine of $1.49 million. “The decision to prosecute has been made in accordance with WorkSafe's General Prosecution Guidelines, which require WorkSafe to consider whether there is sufficient evidence to support a reasonable prospect of conviction and whether bringing a prosecution is in the public interest,” it said.
