Senior Constable Tom Harper has been let off without any conviction after being charged with neglect of duty for falsifying a random breath test .After smelling alcohol on his breath, Senior Constable Harper turned the breathalyser around so that the driver would pass the test.
According to the agreed facts, the ute was being driven by the son of Constable Harper's former supervising sergeant. His lawyer, Tim Lowe, told the Griffith Local Court that while the matter was very serious, he deserved leniency as it was likely no one would have known of his actions if he had not reported them.
