David Mitchell told Newcastle District Court on Wednesday there was no way to know the drugs were on board after he swam under the vessel at Bora Bora.
Lembke, 49, of Mayfield East, and West Australian co-accused Daniel Percy, 36, have pleaded not guilty to importing a commercial quantity of cocaine.Lembke claims he did not know the cocaine was hidden in the twin hulls of the 13-metre catamaran Scarabej. It was the first time the pair had sailed a catamaran from another country to Australia and Mr Mitchell wanted to ensure they weren't carrying anything illegal, checking underneath the vessel at Bora Bora.
The pair sailed into Coffs Harbour on November 10 and were met by Australian Border Force officers to complete immigration formalities and receive clearance to take the catamaran to Pittwater.
