A magistrate has found 37-year-old Bradley Moyle used excessive force but that he was acting honestly in trying to prevent a breach of the peace and arrest the woman., the Mount Gambier Magistrates Court heard Constable Moyle shoved Ms Beck into the back seat of a taxi and then hit her twice with his hand while he was arresting her in what he called "distraction strikes".
She said the shove into the taxi was not excessively forceful and was necessary to prevent a breach of the peace caused by Ms Beck's "erratic, belligerent and, at times, aggressive" drunken behaviour.Magistrate Kossiavelos said the constable had "genuine safety concerns" about her assaulting him or spitting at him.
