Exclusive: More than 100 criminal trials in NSW delayed amid latest COVID-19 outbreak | MWhitbourn

More than 100 criminal trials that were scheduled to start in recent weeks in the NSW Supreme and District courts have been delayed owing to the growing coronavirus outbreak in the state, with some already pushed back to 2022.

If the lockdown continued in September and October, a number of other trials were expected to follow. While the Supreme Court hears the most serious criminal cases, the NSW District Court hears a much higher volume of criminal trials, and has also halted new jury trials amid the latest coronavirus outbreak.

Three accused people so far had elected to be tried by a Supreme Court judge alone without a jury, he said, enabling their trial to proceed via audiovisual link during lockdown and any subsequent COVID-19 restrictions. The chief justice said judges’ schedules would be juggled to help tackle the looming backlog of Supreme Court criminal trials, including having Court of Appeal judges taking on some civil cases assigned to Supreme Court judges, freeing up the latter to deal with criminal trials.
