Ross Fowler's defence lawyer Geoffrey Steward told the jury the officers were just trying to control the situation, ensure their own safety and that of Mr Jackson's partner and the children in the home as well as the wider community.
He suggested the arrival of the police"fired up" Mr Jackson whose partner"was too scared to call police"."He acted in all times in the lawful execution of his duties when he attempted to deal with the unhinged, unpredictable phenomenon that was Brian Jackson that night." Travis Woolnough's lawyer, Malcolm Thomas, said that earlier that night Mr Jackson had threatened to get a knife"to give the cops something to arrest me for".Over two days giving evidence, he denied he was aggressive or violent towards police."Was he free of drugs or high on ice?" the lawyer said.Mr Thomas told the jury the CCTV footage did not show all of what happened that night.
He also raised Mr Jackson's use of alcohol and the drug ice, which the officers claimed was a factor in his behaviour that night, and explained why he did not flinch when they struck him. In at times testy exchanges with both defence lawyers, Mr Jackson maintained that he had not used drugs that night."They've had every chance to drug test me and blood test me."
