If Australians want a true test of the new government’s humanity, they should look at the ongoing struggle of Ned Kelly Emeralds at the intersection of displacement, detention and disability., 37-year-old Ned is entering his 10th year in immigration detention. He still holds fears for his family trapped in Iran.He read about the outlaw in 2013 when working as a library assistant in Darwin detention.

Nevertheless, Ned is subject to a “protection finding” made in 2016 and cannot be deported to Iran. There is no apparent third country available to resettle him, but he was left behind in the minister for home affairs mass release of detainees pre-election 2022.Last month, Ned’s lawyer, Sanmati Verma, wrote to the new immigration minister that Ned was one of the longest-serving detainees in the onshore detention network.

As of late February this year, the average period of time for people held in immigration detention facilities was about two years, andLast year, Verma argued in the Federal Court that the purpose of Ned’s detention had not been carried into effect as soon as reasonably practicable and, because of the date of his arrival, Ned should have been removed to a regional processing centre but instead had been allowed to languish in detention for no lawful purpose.

Medical files show that the International Health and Medical Services doctor refused to consult Ned as he was carrying his mobile phone. Ned regularly films the immigration officers and posts them on his social media. “It’s my only chance to display crime against powerless detainees,” Ned says.

There was no commonwealth in Kelly's time. He was tried & convicted of multiple murders of police officers by the Colony of Victoria. He was pursued throughout nth Vic & sth NSW by police for nearly 2 years, not given shelter & food by the state.
