A refugee who claims he was unlawfully detained in two Melbourne hotels is suing the Australian government.
He spent most of his almost eight years in detention on Manus Island in Papua New Guinea until he was transferred to Australia for medical care in late 2019.Mr Azimitabar was held for 14 months in the Mantra and Park hotels in Melbourne, before being released into the community on a restricted visa."I suffered from asthma and post traumatic stress disorder and I really struggled in the time I was locked up in those so-called hotels," he said.
"There's no provision in the act that says the minister can create an APOD ", solicitor Michael Bradley told AAP." is bringing this case as a test in the interest of everyone whose in that situation or who is still in that situation. It's very courageous of him to do so."The Department of Home Affairs told AAP that as the case is before court it would be inappropriate to comment on it.
Those detained in hotels are typically locked in their rooms 23 hours a day with no access to sunlight and no proper exercise facilities and they have harsher environments than purpose-built detention centres.
pauldutton1968 As it bloody well should be.
🙄
So he wants to sue the tax payer. Deport now
Don't let refugees into this country. They are a total disaster.
Sophiemcneill The use of our courts is a public resource funded by Australian taxpayers. Non-citizens should be barred from litigating spurious claims in our courts.
So it should. What a pathetic regime
SueChapo If it isn’t unlawful, it is definitely immoral. This government is disgraceful in their treatment of refugees, and the worst part is, they couldn’t give a toss 😰
I bet he didn't have a passport when you he 'arrived ' here.
His right, but hope he loses
No I can think of far better places to send them😎
Then they'd need to be deported to the first safe country or home country if it's now safe or be on Christmas island or similar.
Harryslaststand it's a small step I know, but anything that eats away at Australia's abhorrent refugee policy is noteworthy
At least, if he wins then that loop-hole can be slammed shut.
Well time to just send them back then . Simple . I can understand you want a better life , but you also have to understand the process good or bad your choice .
It can't be illegal because Kerryn Phelp's medivac legislation specifically stated they have to be held in detention while here for treatment. It's the law.
The Kurdish-Iranian who first arrived in Australia by boat in 2013 and has never paid a cent in tax is suing the government to get my taxpayer dollars? Put him back in his boat and cast him off Back to the sh!tehole you came from and sue them! Instead of trying to get my money.
Err he was an illegal immigrant was he not.
Go hard and have no mercy for this useless and disgraceful government.
Stupidity will rise to a new level if he wins. More power to him.
