Fraser Ellis’ lawyer on Friday invoked new laws that curtailed the anti-corruption agency’s powers where parliamentary privilege is invoked.

A South Australian MP charged with 23 counts of deception over allegedly fraudulent expenses could have his case dismissed after his lawyer invokedFormer Liberal MP Fraser Ellis, who was recently re-elected as the independent candidate for the seat of Narungga, was last year charged with making more than $18,000 in fraudulent expenses claims following an investigation by the state’s Independent Commission Against Corruption.

In a joint statement in September 2020, Mr Ellis, along with two other MPs who were probed by ICAC, said the agency’s notices to produce information covered documents that touched on parliamentary privilege. “For example, a member of parliament might table incriminating documents in the chamber in an effort to put himself or herself beyond the reach of an investigation of the Commission or Ombudsman.
