Renowned human rights lawyer Geoffrey Robertson says it is unconstitutional to stop Australians returning home from India. 9News

While the government says the travel ban is legal and appropriate under the Biosecurity Act, Mr Robertson says the legislation has hundreds of pages that no one seems to have noticed gives "dictatorial" powers to the minister.

With reports the new coronavirus mutations in India are more infectious, deadly and rampant, Mr Robertson said he agreed it was owed to Australia's largely unvaccinated population to ensure the Indian strains are kept out. It's been reported reports the new coronavirus strains and mutations are more infectious, deadly and rampant within India than previous strains had been. "But now we certainly owe it to them to ban flights for a short time until the plague dies down in India. No tourist flights, no commercial flights from India, that's fine. But to the 9000 Australians, some 600 vulnerable, they are in danger of death, as the Chief Medical Officer admits.
