Breaking The High Court has decided two men who identify as Indigenous are not 'aliens'.

The High Court has found that two Aboriginal men are not"aliens" despite being born outside Australia, presenting a major hurdle to the government's plans to deport them from the country.

The Morrison government is seeking to deport Daniel Love and Brendan Thoms for serious crimes they committed while in Australia. Both men were born abroad with neither holding Australian citizenship, but both identify as Indigenous, with each having one Australian parent.Last year, lawyers for the two men argued they couldn't be considered"aliens" under immigration law.

The pair are seeking damages for false imprisonment after being placed in immigration detention pending their deportation.

That’s the least of their problems... 650,000 ...theres more advocates, activists & assistance than there are aboriginals.

Just decided to identify didn’t think it was that important prior to their run in with the law. Watch out England I’m coming for my citizenship. But I wasn’t born there . You ok with that. And can I collect benefits and English taxpayers pay my legal fees . Thanks

So now anyone who wants to avoid deportation can simply do a 'Bruce Pascoe', and self-identify as being Aboriginal? What a lark! If you're not born in Australia and you don't have Australian citizenship, you're not Australian. End of story.

Ridiculous. Therefore anytime in the future, with some indigenous ancestry, Australian citizenship is automatic. Does this apply to all Australian descendants having kids overseas? If not, it’s not equality, it’s racism.

Quite simply we shouldn’t be allowed as the high court has decided, to put in place laws that mean Indigenous Australians can be deported. I am however not advocating for no punishment for crimes committed.

circumventing ones crimes and betrayal of the community lived within by virtue of one's descent and heritage is outrageous, even more so when considering the absence of citizenship or birth within the country to which both claim recourse; identity is not a replacement for the law
