The government has until 2pm on Wednesday to decide whether it would claim public interest immunity to conceal files related to the September 14 curfew extension

The writ names Victoria's deputy public health commander, Associate Professor Michelle Giles, as the defendant.

Ms Loielo’s lawyers also allege Dr Giles’ decision to extend the curfew is unlawful because she was acting under the dictation of Premier Daniel Andrews, and that she did not exercise her independent judgment. But Dr Giles rejected that assertion as well, saying she had seen data that showed a “clear and direct correlation between the effect of the stage four restrictions and the reduction of case numbers”.

Put in place to slow the spread of COVID-19, the curfew was initially in force between 8pm and 5am but was moved back to 9pm on Monday, September 14.

Of course they should claim it. That immunity (and others) exists for a reason - and good reason. There are other ways to lead the evidence the plaintiffs need and litigate their arguments - assuming they have a case.
