George Pell appeal fails, Cardinal to serve out full jail term

Chief Justice Ferguson said she and Justice Maxwell rejected all 13 of the submissions made by Pell's lawyers at appeal, that it was impossible or improbable that he abused the boys inside the cathedral.His lawyers could now take his appeal to the High Court in a final bid to have the cardinal’s convictions quashed.

He was ordered to serve at least three years and eight months behind bars, meaning he will not be eligible for parole until the end of 2022. The cardinal said he was always accompanied by church officials and would have never been left alone with two choirboys in the sacristy. Mr Walker also argued the crimes were “physically impossible” because Mr Pell’s robes were “heavy and cumbersome” and difficult to manoeuvre.

His lawyers argued that County Court Chief Judge Peter Kidd erred when he would not allow the defence team to play to the jury a video graphic depicting where celebrants had allegedly been after Sunday Mass at St Patrick’s Cathedral. Pell is already being sued by a victim of notorious paedophile Christian Brother Edward ‘Ted’ Dowlan, who alleges the disgraced cardinal did nothing to protect him.

Under the Melbourne Response, victims received compensation capped at $50,000 if they signed away their right to pursue the matter in court. It was later revealed that victims who instead went through the courts received $270,000 compensation on average. The Melbourne Response cap was increased in 2016 to $150,000.

How the testimony of a single person with no witnesses or evidence, relying on events that allegedly happened decades ago, can put a man behind bars is, to say the least, quite worrying. Let's hope Pell takes it to the High Court.
