Facebook and Google at centre of second wave of defamation reform | MWhitbourn

A second wave of reforms to Australia’s national defamation laws will clarify when social media platforms, search engines and online forum administrators should be responsible for the defamatory posts or content of third parties, as NSW and Victoria forge ahead with plans to overhaul the laws.

Each jurisdiction agreed to pass mirror legislation to ensure the regime is nationally consistent but laggard states and territories including Queensland and Western Australia have yet to take action. The responsibility of the original author of defamatory material is “not in question”, the paper notes, but in an online environment a range of other organisations enable the publication including web page hosts, social media companies and search engines providing “snippets” of materials in search results.

NSW Attorney-General Mark Speakman said getting the balance right with any new laws was “crucial to avoid online commentary being blocked unnecessarily”.
