Exclusive: Commonwealth warns against 'illegal' water diversion sought by Barilaro

Large amounts of water available for irrigation contradict claims from NSW Deputy Premier John Barilaro that farmers had been sacrificed for the environmental objectives of the "failed" Murray Darling Basin Plan.

Mr Barliro’s comments were focused on the NSW Murray catchment, based around Deniliquin in the Riverina, where prolonged drought has left irrigators facing their third season without general security water access.Yet, despite the low allocation of water, irrigators have instead chosen to “carry over” their rights from previous years and leave the water in upstream dams.

Jody Swirepik, the Commonwealth Environment Water Holder, said it was illegal to divert these federal holdings away from the environment. State governments control the release of water entitlements, even those owned by the Commonwealth. NSW, if it were to follow Mr Barilaro's demands, would have to agree to break the law and direct environment water to NSW farmers, a step which Victorian Water Minister Lisa Neville hasFormer CEWH David Papps said Mr Barilaro's plan to take environment water could unravel the entire basin plan.
