"If the class action is successful it will be a binding judgement that comes out and it will be rightly extremely expensive for the government because they will be required to refund all of the unlawful debts and they will be required to compensate people," he said.

The class action, which was prompted by Labor's spokesperson for Government Services Bill Shorten approaching Gordon Legal, will assert the government had unlawfully taken tens of millions of dollars from "many thousands" of Centrelink recipients, using a "flawed calculation". "The two applicants had their debt entirely waived after the Federal Court action had been brought. So there is dispute now in the Federal Court about whether there is a live issue to decide anymore."

Robodebt was introduced in 2016 and since then has about 500,000 debts have been raised, according to figures released in the Senate. "Announcing a class action into income compliance with no lodged case, no lodged papers, and indeed no plaintiffs. And with no plaintiffs coming forward, this is what it is: it's just a political stunt," he said.

"Twenty per cent of those have adequately explained it. Of the remainder, 0.8 - 0.8 - per cent have been overturned on appeal. That's a 99.2 per cent effectiveness rate for those who cannot explain why what they reported to Centrelink does not equal what they told the ATO in their tax returns."
