A café paid employees in food and drink instead of cash. 9News

Café 63 in Westfield Chermside is today facing legal action from the Fair Work Ombudsman following the discovery that 11 employees were allegedly paid part of their wages in meals, desserts and drinks between August 2017 and January 2018.

Company director and manager Tien Hoang Le, manager Minh Vo Duy Nguyen and owner-director Hamish Watson have been summoned to appear in the Federal Circuit Court to answer the allegations. Cafe 63 in Westfield Chermside was investigated by the Fair Work Ombudsman after allegations it was paying workers in food instead of money.The trio are accused of exploiting workers, most of whom were visa holders aged under 21 who worked as cooks, kitchen attendants and food and beverage attendants.

"All employees in Australia are entitled to be paid the minimum pay rates that apply to their positions – in money, not food," Fair Work Ombudsman Sandra Parker said. "If we consider that employers are breaching their lawful obligation, we will take enforcement action so employees receive what they are entitled to.
