Brandis, eyeing the US example, warns judicial creep can undermine democracy | BevanShields

Former attorney-general George Brandis says the fight over Ruth Bader Ginsburg's seat on the US Supreme Court should serve as a cautionary tale to lawyers and activists who want judges to have a greater role in ethical and political decisions.

"One of the reasons for that is that there is an implicit and deeply grained public assumption...that the courts, the judges, are the neutral umpires and not the protagonists."I can't help but compare that virtuous state of affairs with the debate you get in the United States - as we're seeing at the moment - about the appointment of judges to their highest court."

A Human Rights Act has been in force in Britain for two decades but the government is preparing to review the Tony Blair-era laws, which could lead to changes or even repeal. Cox supports changes to curb the creeping "judicialisation of politics". A barrister before entering the Senate in 2000, Brandis said he had seen the inner workings of courts and parliaments and "I am very wary about giving judges political power".
