Trump, the Republican candidate challenging Democratic President Joe Biden in the Nov 5 US election, is the first former president to be criminally prosecuted.The case is due to be argued before the justices on April 25. Trump has appealed a lower court’s rejection of his request to be shielded from the criminal case being pursued by Special Counsel Jack Smith because he was serving as president when he took the actions at the centre of the case.

Mr Smith was appointed by US Attorney-General Merrick Garland in November 2022. In August 2023, Mr Smith brought four federal criminal counts against Trump in the election subversion case, including conspiring to defraud the United States, obstructing the congressional certification of Mr Biden’s electoral victory and conspiring to do so, and conspiring against right of Americans to vote.

Mr Smith said Trump’s criminal charges reflect an alleged effort to “perpetuate himself in power and prevent the lawful winner of the 2020 presidential election from taking office. The charged crimes strike at the heart of our democracy.”
