The trial in a closely watched legal fight over Seattle ’s Denny Blaine Park began Wednesday, where advocates for the city’s longtime nude beach are defending public nudity as a lawful and historically protected use of the waterfront park.

The case pits the advocacy group Friends of Denny Blaine against neighborhood group Denny Blaine Park for All, which previously sued the city with allegations that the park has become a public nuisance because of lewd conduct, drug use, and safety concerns. At issue is whether non-sexual nudity at the Lake Washington park can legally continue and whether nearby residents can force broader restrictions or closure of the beach area.

Friends of Denny Blaine said in a press release that the neighborhood group is attempting to “fundamentally change the character” of one of Seattle’s best-known clothing-optional spaces. The dispute has intensified over the past two years after neighbors documented alleged public sex acts, drug use, lewd conduct, and other illegal activity at the park.

In July 2025, King County Superior Court Judge Samuel Chung ordered Seattle to develop an abatement plan after finding that conditions at the park constituted a public nuisance. Rather than closing the park, the city implemented a plan dividing Denny Blaine into “clothing optional” and “clothing required” zones, installing fencing and signage and increasing ranger patrols.

The latest phase of the case comes after the judge ruled earlier this month that topless sunbathing is allowed throughout the park, including in areas labeled “clothing required. ” The ruling followed a motion from Friends of Denny Blaine arguing that toplessness had long been permitted at the beach and was being unfairly targeted by private security patrols hired by nearby homeowners.

Friends of Denny Blaine argues the park has served for decades as a gathering place for Seattle’s LGBTQ+ community and was added to the Washington Heritage Register in 2025 as what supporters describe as the state’s first recognized LGBTQ nude beach. In its pretrial brief, the group described Denny Blaine as “a cherished and long-standing nude beach” and said the park has been used for nude recreation since at least the mid-20th century.

The filing argues that “simple nudity” is lawful under Washington law and distinct from illegal lewd conduct. The brief also contends that the city’s enforcement efforts have reduced incidents at the park and that plaintiffs knowingly purchased homes near a beach long associated with nude recreation. Neighbors involved in the lawsuit have maintained the case is about public safety rather than opposition to LGBTQ park users or nudity itself.

“We want our park to be exactly what the name says: a park for all,” Denny Blaine Park for All spokesperson Lee Keller previously told KOMO News. Friends of Denny Blaine counters that lewd behavior should be addressed through targeted law enforcement, not a blanket ban on lawful nudity. The group’s filing argues that at least some nude expression at the park is constitutionally protected under the First Amendment and Washington state law.
