The Sandiganbayan Second Division has ruled that there was no delay in the conduct of preliminary investigation in the graft and breach of conduct case filed against officials of the Cagayan de Oro Water District (COWD).

COWD Chairman Francisco Mendez, Secretary Raymundo Java, and Assistant Secretary Sandy Bass Sr. all tried to convince the anti-graft court that the computation of the length of period should be reckoned from June 17, 2013.

However, the Sandiganbayan found no merit in their arguments. “It is settled that the period spent for case build-up or fact-finding investigations of the Ombudsman prior to the filing of a formal complaint by the FIU will not be counted in determining the existence of inordinate delay,” the resolution read.

The three officials are facing the charges together with Palawan Governor Jose Alvarez in his capacity as the president of Rio Verde Water Consortium Inc. .
