Lacson: ‘Constitutional crisis’ if SC approves SolGen ‘quo warranto’ petition to revoke ABS-CBN franchise

A quo warranto petition to cancel ABS-CBN’s franchise could result in a “constitutional crisis” if granted by the Supreme Court , Sen. Panfilo Lacson said on Saturday.In a radio interview, Lacson said Congress has authority over matters of legislative franchises granted to corporations and public utilities, and that it would be unnecessary for Solicitor General Jose Calida to pursue his reported plan to file a ‘quo warranto’ petition against broadcast network ABS-CBN.

“Kami ang dapat masusunod kung mare-renew ba ng another 25 years ang media outfit…So I think medyo duplicitous ang move para pigilan, kasi hindi talaga kayang pigilan ang Kongreso ,” he said. “Baka magkaroon tayo ng constitutional crisis. Kasi halimbawa, kung mag-grant ang SC ng quo warranto at kasalukuyang nagsasagawa kami ng plenary deliberation sa renewal ng franchise ng ABS-CBN, ano ang mananaig doon? Of course sabi nila, pag sinabi ng SC ganito, it becomes part of the law of the land, pero Constitution itong pinag-uusapan natin.

A recent report said Calida is mulling asking the SC to revoke ABS-CBN’s 25-year franchise through a quo warranto petition. The broadcast company’s franchise is set to expire in March this year.

The power of Congress to grant a franchise comes with the responsibility to check if the applicant is compliant with existing laws. Obviously, there is a fast speeding train emblazoned with YES to the franchise, nevermind if no less than the President complained of non-aired ads
