The Department of Labor and Employment has signed an order extending to a year the allowable period an employer can put a worker on"floating status" amid a pandemic.

Labor Secretary Silvestre Bello III has amended a portion of the Labor Code which allowed employers to temporarily retrench a worker for a maximum of six months. In the latest order, an employee can now be laid off for up to one year if there is a pandemic, such as the ongoing COVID-19 global crisis.dated Oct. 23 allowed the extension of the suspension of employment"in case of declaration of war, pandemic, or similar national emergencies.

DOLE Undersecretary Benjo Benavidez on Wednesday said the employer and staff must reach an agreement before the worker can be placed on extended floating status. The company should also submit a report to inform DOLE of the work set-up.

Workers on floating status are still considered employees but firms are not mandated to pay their salaries during this time. When the allowable period is up, the employee can either be permanently retrenched with separation pay or asked to return to work.

kawawa pa rin mga empleyado't mangagawa. Floating status means no work no pay, so they will delay their corporate decision, ganun? If so, dapat naman payagan nila mga empleado na tumanggap ng ibang work. Yung clause na bawal mag-work sa iba hinders their way to livelihood.
