Department of Justice prosecutors have dismissed one of the complaints about the missing sabungeros.

In a resolution, the DOJ dismissed the complaint for kidnapping and serious illegal detention against farm manager Julie Patidongan over the alleged detention of Michael Bautista due to a lack of probable cause to support the filing of charges in court.

"Complainant PNP-CIDG had all the opportunity to establish the authenticity or identify the person who owned or took the said video footage or that it was free from any alteration, manipulation, and tampering," it said."While this office does not put much weight on the denials and allegations of respondent Patidongan, we find that complainants failed to present proof to establish that there exists probable cause against the respondent," it said.

According to the DOJ, though Bautista’s family may identify him through his clothing, mannerisms, and stature, the same cannot be said about the identification of Patidongan as one of the men who took Bautista. However, Justice Secretary Jesus Crispin Remulla said the prosecutors should not have dismissed the complaint for the PNP's failure to authenticate.
