The Commission on Audit has ordered Dagupan City to pay a contractor some P10.3 milion for the completion of various infrastructure projects that were implemented in 2012, during the term of the then-mayor’s political foe.

In a decision on a money claim petition filed in 2016 by contractor LXS Builders and Supplies , the COA-Commission Proper upheld the principal contention of the petitioner but rejected its claim for legal interest, exemplary damages, and attorney’s fees.

The projects involved the construction of lateral drainage at Santiago creek, P7.8 million; repair of day care centers, P1.24 million; and improvement of the Japanese Garden Compound, P1.41 million, among others. In response to LXS’s collection bid, the city government, through its legal officer, declared that no payment could be made because the documents required for the processing of payments were not turned over to them by the former Bids and Awards Committee Secretariat.
