– The Court of Appeals has junked the petition of Panay Electric Co. , the embattled power distributor of this city, to stop the expropriation case by a rival firm owned by business tycoon Enrique Razon Jr.The Manila Bulletin obtained a copy of the decision of the CA’s 18th Division, which is based in Cebu City, that did not grant the petition of PECO for a temporary restraining order and writ of preliminary injunction against MORE Electric and Power Corp. .
PECO, which failed to renew its government franchise, is battling to save its facilities in what it claims as an “unconstitutional” move by MORE Power to take its private assets. “The CA’s decision is moot and academic since the case has been elevated to the Supreme Court ,” explained lawyer Estrella Elamparo, senior partner of Divina Law firm.
