CHR Spokesperson Atty. Jacqueline Ann de Guia said in a statement that this broad definition might pave the road to abuse because “it tends to blur the distinction between terroristic activities and ordinary crimes already punishable by the Revised Penal Code and other pertinent laws.”

Once individuals are tagged as terrorists, the CHR is concerned that they can be detained without a judicial warrant. As of now, individuals may be detained without a warrant only for 12 hours, 18 hours, or 36 hours for light, less grave, or grave offenses, respectively. This is in due consideration of the suspect’s physical and mental health. After, they will be brought before a public prosecutor to determine the validity of the arrest made.

“With this provision, the bill also grants to the Executive branch a power usually reserved for the courts as part of the Judiciary intended to serve as a check-and-balance mechanism against abuse,” added de Guia.

Any form of power/law can lead to abuse naman eh.. nasasa tao na yan. Para mo yan pigilan at ang premise mo eh 'abuse', malabo naman ata yan. kayo diyan sa CHR, puro kayo kontra. Sana pag mabuti naman para sa taong bayan eh mag-agree naman kayo. Hwag puro maka sarili.
