The defence objected to the tendering of the recording as evidence

Miss Ojukwu is standing trial for Mr Ataga’s murder before a Lagos High Court sitting at the Tafawa Balewa Square.

The court also heard when Mr Mohammed asked her why she had not returned since Tuesday night that she left, and she said that she went for a meeting.In the conversation, the court further heard as Mr Mohammed told Miss Ojukwu that since she was not around, he could not go and knock on her room door.While she was saying she was coming, Mr Mohammed asked her to use her phone number to call him, so that he could have the number. She agreed.

The prosecution tendered the disc in evidence but the first defendant’s counsel, Onwuka Egwu, objected on grounds that Mr Bamidele was not the maker of the disc.He argued that there was no satisfactory reason for the prosecution to desire that the court should accept a ‘hearsay document’ when the author had given evidence as PW2.

”Due process must be followed. This is a court of law, they did not lay the foundation, the author of this document is supposed to appear before your lordship. This is a hearsay”. The three defendants were arraigned on 12 October 2021 on a nine-count charge brought against them by Lagos State Government.
