Justice Abubakar Yahaya led two other justices of the appellate court to void the proceedings leading to the conviction and sentencing.
Speaking with newsmen, Magaji said: “by this decision, setting aside the judgment of the Special Court Martial, the proceedings, conviction and sentence of the court never existed in the eyes of the law. The alleged offence were punishable under Sections 56, 66, 90 and 113 of the Armed Forces Act , CAP A20, LFN, 2004.
At the close of the prosecution’s case, the appellant made a no-case submission in respect of all the remaining 8 counts.
