Thomas Bloxham, who oversaw bond funds for the Comal County school district, successfully appealed his conviction for theft by a public servant.
An appeals court has overturned a former Comal Independent School District administrator’s conviction on a charge of theft by a public servant, ruling that prosecutors forced him to testify with a promise of immunity, then used that testimony against him. Thomas Bloxham , a former Comal ISD assistant superintendent, was found guilty by a jury in 2022 and sentenced to 10 years in prison.
Top stories from the booming region Bloxham appealed the conviction and in August, the state’s First Court of Appeals ruled that his Fifth Amendment rights to avoid self-incrimination had been violated. When Bloxham was subpoenaed to testify before a Comal County grand jury in 2016, he refused to answer questions. The District Attorney’s office then obtained a court order forcing Bloxham to testify, but guaranteeing that his compelled testimony would not be used against him.
In 'Trump Train' case, focus shifts to drivers' intent The appeals court said that the burden was on the state to prove that its evidence was from “legitimate, independent sources,” and found that the prosecutors did not meet that burden. The trial court also erroneously put the responsibility on Bloxham by instructing him to object to evidence, instead of requiring the state to prove its evidence was untainted, according to the ruling.
