A British judge's ruling that a couple are the legal parents of their adult son under English law is an"important victory" for people with children born through surrogacy arrangements, a lawyer has said.
The judge said the couple's son was born in the US in 1998 after they made a surrogacy arrangement there. "That reflected the legal position in the United States, where the surrogacy arrangement had taken place, and orders made there confirmed that position. The judge indicated the surrogate mother had not objected to the order, but it was first time a judge based in England or Wales had been asked to consider making a parental order for a"person who is now an adult".
