A fast-food outlet has been ordered to pay almost €17,000 in compensation to a female worker who was forced to quit her job after being subjected to constant sexual harassment at work by a male colleague.
WRC adjudication officer, Kara Turner, said the takeaway had failed to have procedures in place to promote a workplace free from harassment and to protect its staff. She also determined that the takeaway had breached various pieces of employment legislation, including laws relating to written contracts, holiday pay and rest breaks.
Although the takeaway’s owner was aware of the issue, she claimed both he and the chef laughed when the matter was raised with them. The woman said she felt she could not leave the job as she was under financial pressure. The witness said his general approach to unacceptable conduct in the workplace, if he was aware of it, would be to have spoken with the chef. He told the WRC that there had been no need to provide the complainant with pay slips or a written contract because she was a part-time worker.
