Donegal couple William and Grainne Doherty are the first homeowners to initiate proceedings as part of coordinated legal action over defective blocks

A Donegal-based block manufacturer allowed non-compliant concrete products to remain on the market when it was aware they were defective, papers filed in the High Court allege.

William and Grainne Doherty, a couple from Donegal, today became the first homeowners to initiate proceedings in the High Court as part of an action against Donegal County Council, the National Standards Authority of Ireland and Cassidy Brothers. The plaintiffs also allege that the Cassidys failed to carry out any or adequate testing in accordance with applicable standards, and failed “to properly consider the results of such testing and/or analysis that was carried out”.

The plaintiffs in the case allege that the council, which was the market surveillance authority in the period when the blocks were sold to the Doherty family, failed to ensure that non-conforming products provided by the company were removed from circulation.
