Gary Turner could now face a substantial legal bill after the judge ruled the most likely cause of the accident was Mr Turner's failure to keep a proper lookout, together with the use of earphones to listen to music.
Mr Turner from Athgarvan Road, Newbridge in County Kildare, sued over the collision at the Maddenstown gallops on the Curragh plain on the morning of Saturday, 6 September 2014. The horses were said to be galloping at about 40 miles per hour . He suffered a dislocated shoulder as well as other injuries. He has also been diagnosed with post traumatic stress disorder and says he is in pain constantly.
Mr Justice Keane concluded the "proximate cause" of the accident was Mr Turner's failure to keep a proper lookout, together with the use of earphones to listen to music.
According to reports Judge told him to, 'Jog on!'

I go out walking but only put in 1 earphone just in case I don't hear cars etc. You know it makes sense.
Surely If running horses at 60 mph you need to have look out? Or you should be able to stop ? On do we just run over everyone on our path if they have headphones it, the curragh plains is for everybody, not just for horses.
I thought horses had the right of way.. ?
As traumatic it would be to be hit by horse the judge was right here. I hope that this is the start of common sense judgements
